The complaint of victimisation is struck out.

REASONS

The claimant was ordered to pay a deposit of £100 following a preliminary hearing held on 29 June 2023. The Order was sent to the claimant on 7 July 2023.The claimant has failed to pay the deposit. The complaint of victimisation is therefore struck out under rule 39(4) of the Employment Tribunals Rules of Procedure 2013. I am satisfied that these proceedings have come to its attention because they were served on Impellico Facilities Management and responded to by the sole director of Impellico Facilities Management Ltd.[2]It appears from Companies House that this company has gone into liquidation. This judgment will be copied to the liquidators.[3]The complaint of failure to pay for accrued holiday pay is dismissed on withdrawal by the Claimant, the Respondent now having paid the sum owed.[4]The complaint of breach of contract in respect of notice pay is well-founded and succeeds. The Respondent shall pay the Claimant damages of £320 in respect of the failure to give one week’s notice.[5]The complaint of harassment related to race is well-founded and succeeds.[6]The Respondent shall pay the Claimant £3000 compensation for injury to feelings plus £212 interest on that sum, making a total of £3212.
