The respondent has not filed a response to the claim and a rule 21 warning letter has previously been sent. The claimant attended a case management hearing by telephone on 12 May 2023. The parties were directed to file and serve witness evidence by 9 June 2023. Neither party complied. The parties were reminded of this direction by the Tribunal on 16 June 2023. No further correspondence or evidence has been received from either party. All correspondence from the Tribunal has been sent to the correct addresses for the parties. The Tribunal attempted to telephone the claimant three times between 10.05am and 10.20am on the morning of the hearing and left a voicemail message. The Tribunal also emailed the claimant at 10.20am enclosing again the joining details for the hearing. No response was received from the claimant and he did not join the hearing. The hearing room was closed and the hearing concluded at 10.30am. JUDGMENT[3]The claimant failed to attend the hearing and the claim is dismissed (rule 47 Employment Tribunal Rules 2013).
