Employment Judge Bax DatedDate 12 August 2024

JUDGMENT

The claim is struck out.

REASONS

[1]On 14 April 2024, the Claimant was ordered to send to the Respondent a statement about her alleged disability, together with medical evidence, by 27 May 2024.[2]After the Respondent was chased by the Tribunal for its position on disability, the Respondent informed the Tribunal on 21 June 2024 that it had not received the statement from the Claimant.[3]The Claimant was required to provide comments by 4 July 2024, none were received.[4]By a letter dated 16th July 2024 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because:  It has not been actively pursued.[5]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The claim is therefore struck out.[6]The hearing fixed for 13th August 2024 will not take place.
