JUDGMENT

[1]The Second Respondent being the employer of the claimant, the claimant’s claim against the First Respondent is dismissed.[2]The claim is sisted to 12 November 2019 to enable the claimant to apply to the Secretary of State for a payment under s.166 of the Employment Rights Act 1996.[3]On or before 12 November 2019 the claimant is to notify the Tribunal if she is continuing her claim or whether it is withdrawn. If she is continuing she must inform the Tribunal of the date on which the respondent company was restored to the register at Companies House.[4]In default of such notification on or before 2 December 2019 and unless by that 5 date the claimant shows cause why the claim should not be dismissed, the claim is dismissed.
