JUDGMENT
The claim is struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds• that the claim has not been actively pursued in terms of rule 37(1)(d)REASONS
At the Preliminary Hearing held on 07 January 2021 , the claimant was ordered to show cause, within fourteen days of the order being issued, why he did not attend the hearing. The order stated that a failure to reply would result in the claim being struck out on the grounds that the claim had not been actively pursued. The order was issued on 27 January 2021 and by 10 February 2021 , no reply had been received from the Claimant.[2]On 19 April 2021 the Tribunal gave the claimant an opportunity to give written reasons by 04 May 2021 or to request a hearing in order to consider why the claim should not be struck out.[3]The claimant has failed to give an acceptable reason why such a judgment should not be made or to request a hearing. The Tribunal -thereforestrikes out the claim. 1 .
