The claim is struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds that the claim has not been actively pursued in terms of rule 37(1)(d).

[1]The corresponded to the claimant at the address provided has been returned marked ‘gone away’. No address has been provided by the claimant. The claimant’s previous agents have withdrawn from acting for him. They do not hold for him any address other than that in the claim form. In those circumstances it appears that the claim is not being actively pursued. It is therefore struck out.
