JUDGMENT
The claim is struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds of noncompliance with an Order of the Tribunal in terms of rule 37(1)(c); and that the claim has not been actively pursued in terms of rule 37(1)(d).REASONS
[1]The claimant presented an application to the Employment Tribunal of 9 December 2019 in which he claimed unfair dismissal and unpaid wages/holiday pay. The respondent lodged a response. A case management order was issued on 14 January 2020 requiring the claimant to send to the respondent a written statement of loss with supporting documentation. The claimant did not comply with the order. On 25 February 2020, the Employment Tribunal wrote to the claimant seeking his comments on the respondent’s representative application for an Unless Order. The claimant failed to respond to the Employment Tribunal’s letter.[2]On 5 March 2020 the Tribunal gave the claimant an opportunity to give written reasons by 19 March 2020 or to request a hearing in order to consider why the claim should not be struck out.[3]The claimant has failed to give an acceptable reason why such a judgment should not be made or to request a hearing. The Tribunal therefore strikes out the claim.
