The Judgment of the Employment Tribunal is that the Claimant’s claim in respect of holiday pay is dismissed.REASONS
[1]This case called for a Final Hearing by way of CVP. No Response had been lodged by the Respondent (who was in liquidation). The Respondent’s insolvency practitioners had informed the tribunal in advance of the Hearing that they were not going to enter appearance.[2]The Claimant had been notified of the CVP Hearing by the tribunal administration. The Claimant did not appear at the commencement of the tribunal. The tribunal elayed the start of the Hearing for the CVP Clerk to make attempts to contact the Claimant. The CVP Clerk left messages on his mobile phone. The Claimant did not respond.[3]The tribunal accordingly dismissed the Claim.
