JUDGMENT
[1]The claimants lodged claims with the Tribunal in which they claimed they were due a redundancy payment and notice pay following the termination of their employment. The respondent resisted the claim but only to the extent of disputing the initial sums claimed.[2]Following a case management hearing which took place on 29 May all parties were in agreement that the respondent was due in respect of Mrs Brewster a redundancy payment of £1477.80 and pay in lieu of notice of £985.20. In respect of Ms Drinkwater the respondent was due a redundancy payment of £1182.24 and pay in lieu of notice of £788.16. Details of the calculation can be found in the note issued following the Preliminary Hearing.[3]On the basis of the material before me from the parties I considered that a determination of the case could properly be made in terms of Rule 21 of the Employment Tribunal Rules of Procedure 2013 and give the following judgment: The respondent shall pay to the first claimant Mrs Brewster the following sums:-(1) A redundancy payment of One Thousand, Four Hundred and Seventy Seven Pounds and Eighty Pence (£1477.80).(2) The sum of Nine Hundred and Eighty Five Pounds and Twenty Pence (£985.20) as damages for breach of contract (failure to give notice of termination of employment.[4]The respondent shall pay to the second claimant Ms Drinkwater the following sums:-(1) A redundancy payment of One Thousand, One Hundred and Eighty Two Pounds and Twenty Four Pence (£1182.24).(2) The sum of Seven Hundred and Eighty Eight Pounds and Sixteen Pence (£788.16) as damages for breach of contract (failure to give notice of termination of employment).
