Mr Gregor MacMillan v Hal F London: S/4113175/2018

EMPLOYMENT TRIBUNALS (SCOTLAND)
Case No 4113175/2018Venue GlasgowHearing 26 October 2018
Mr Gregor MacMillanClaimantHal F LondonRespondent
Employment Judge Lucy WisemanDate 30 October 2018

JUDGMENT

The tribunal decided to dismiss the claim.

REASONS

[1]The claimant presented a claim to the Employment Tribunal on the 9 August 2018 alleging he had not been paid his final week’s pay.[2]The respondent did not enter a response.[3]The claimant did not provide details of his pay on the claim form. A letter was sent to him on the 17 September asking him to provide details of the amount owed to him in arrears of pay. The claimant did not respond to this letter and so a reminder was sent on the 1 October. The claimant did not respond to the reminder. An Employment Judge directed the claim should proceed to the Hearing arranged for today.[4]The claimant did not attend the Hearing. A clerk telephoned the claimant using the number provided on the claim form: there was no response. E.T. Z4 (WR)[5]I had regard to the fact the claimant has had an opportunity to provide details of his claim in writing, and an opportunity to attend a hearing in person. The claimant has not taken up either of these opportunities, and has not made any contact with the tribunal to provide an explanation. I decided in the circumstances to dismiss the claim.
