No response has been presented to this claim and an Employment Judge has decided to issue the following judgment on the available material under rule 21:[1]The respondent has failed to pay the claimant’s holiday entitlement and is ordered to pay the claimant the sum of £1,642[2]The hearing listed on Friday 19 October 2018 at 2pm is cancelled.REASONS
[1]The claimant presented an application to the Tribunal on 2 August 2018 in which she claimed holiday pay. The claimant worked for the respondent from 23 November 2017 until 14 July 2018. During that period, she took one day’s holiday.[2]The claimant’s employment lasted 33 weeks. Her weekly gross pay was £490. The claimant’s holiday entitlement at termination was 5.6 x 33/52 = 3.55 weeks or 17.75 days less one day’s holiday taken = 16.75 days or 3.35 weeks. 3.35 x £490 = £1,641.50 or £1,642 rounded to the nearest whole pound. The claimant is to account to HMRC for any tax and national insurance due on this sum.
