JUDGMENT
The claim is struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds that the claim has not been actively pursued in terms of rule 37(1)(d).REASONS
[1]On 2 December 2022 the Tribunal wrote to the claimant seeking an update as to whether she intended to pursue the claim or wished to withdraw her claim. No reply was received from the claimant.[2]On 5 December 2022 we received a call from the person who resides at the address we have for the claimant stating she no longer lives there.[3]On 6 December 2022 the Tribunal wrote to the claimant’s previous representative, asking for an up to date address but the only address they had was the same as the address we hold.[6]The claimant has failed to respond and has failed to update the Tribunal of any change of address and we have no other means of contacting her. The Tribunal therefore strikes out the claim.
