JUDGMENT
The Judgment of the Employment, under Rule 64 of the Employment Tribunal (Constitution and Rules of Procedure) Regulations 2013 (the Rules) by the consent of the parties is that:[1]The Claimants were employed by the Respondent in various descriptions of employee.[2]On 14th February 2018, Paul Dounis and Steven Ross of RSM Restructuring Advisory LLP were appointed as Administrators of the Respondents.[3]On 14th February 201 8, the Claimants were dismissed by the Respondents, by reason of redundancy,[4]The Respondents did not inform and consult with the Claimants in accordance with the provisions of s.188 and S.188A of The Trade Union and Labour Relations (Consolidation) Act 1992 (“the Act”).[5]The Claimants have raised a complaint pursuant to section 189 of the Act seeking a protective award in respect of that failure.[6]The Tribunal declares the Claimant’s claims are well founded; makes a protective award in favour of the Claimants; and orders the Respondent to pay remuneration for a protected period of 8 weeks from 14th February 2018. The Claimants agree to seek payment from the Insolvency Service.
