JUDGMENT

[1]The Claimant’s application to amend his claim to include a claim for unpaid holiday pay is allowed.[2]The Claimant succeeds in his claim for unpaid wages and the Respondent shall pay to the Claimant the sum of SIX THOUSAND, SEVEN HUNDRED AND THIRTY FOUR POUNDS (£6,734). This is the net figure which the Claimant is entitled to receive. The Respondent shall be responsible for accounting to HMRC for income tax and national insurance payments due.[3]The Claimant succeeds in his claim for unpaid holiday pay and the Respondent shall pay to the Claimant the sum of FOUR HUNDRED AND FORTY ONE POUNDS AND EIGHTY PENCE (£441.80). This is the net Active: 107939600 v 1 figure which the Claimant is entitled to receive. The Respondent shall be responsible for accounting to HMRC for income tax and national insurance payments due.[4]The Claimant succeeds in his claim for recovery of pension contributions deducted from the Claimant’s wages by (and subsequently returned to) the Respondent and the Respondent shall pay to the Claimant the sum of FOUR HUNDRED AND SIXTY NINE POUNDS AND FIFTY ONE PENCE (£469.51). The Respondent shall be liable to account to HMRC for any income tax or national insurance contributions which may be due in respect of the said payment.
