JUDGMENT
The claims against the 1 st named respondent only, The Vapour Lounge Limited (Dissolved), are struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds they have no reasonable prospect of success in terms of rule 37(1 )(a).REASONS
1 . On 12 April 2023 the Tribunal wrote to the claimants’ representative to inform them that the 1 st named respondent, The Vapour Lounge Lauriston Ltd, was dissolved on 28 December 2022.[2]The T ribunal gave the claimants’ representative an opportunity to confirm their intentions regarding the claims against the 1 st named respondent by 26 April 2023. Otherwise, the claims would be referred to an Employment Judge to consider striking out the claims against the 1 st named respondent on the grounds they have no reasonable prospects of success. No reply was received from the claimants’ representative.[3]The claimants’ representative has failed to give an acceptable reason why such a judgment should not be made or to request a hearing. The Tribunal therefore strikes out the claims against the 1 st named respondent.
