Mr T Gallagher v IT Fleet Automotive Ltd: 4109656/2021

EMPLOYMENT TRIBUNALS (SCOTLAND)
Case No 4109656/2021
Mr T GallagherClaimantIT Fleet Automotive LimitedRespondent
Employment Judge P O'DonnellDate 16 August 2021

JUDGMENT

The claim is struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds that the claim has not been actively pursued in terms of rule 37(1)(d).

REASONS

[11]On 24 June 2021, the Tribunal wrote to the claimant asking him to specify in writing by 08 July 2021 all the ways in which he will argue that the dismissal, or the procedure leading to it, was unfair. 2. On 1 3 July 2021, the respondent made an application to the Tribunal to strike out the claim, noting the claimant had failed to reply to that correspondence. 3. On 19 July 2021, the Tribunal issued a reminder by email correspondence to the claimant, but again no reply was received. 4. On 30 July 2021, the Tribunal gave the claimant an opportunity to give written reasons by 13 August 2021 or to request a hearing in order to consider why the claim should not be struck out. 5. The claimant has failed to give an acceptable reason why such a judgment should not be made or to request a hearing. The Tribunal therefore strikes out the claim.
