REASONS

[1]This was a hearing that took place to determine claims for sums the claimant argued were due to him. In the course of the Hearing agreement was reached as to resolution of the claims.[2]The respondent agreed to pay the claimant the following sums (on or before 24 December 2021):(a) Holiday pay in the gross sum of £471.15 (28 days’ pay), subject to deduction of such sums as required by law; and(b) Damages in respect of notice pay in the sum of £673. This is a net sum but has been calculated using gross pay to reflect the likelihood that the claimant will have to pay tax on this sum as “Post Employment Notice Pay”.[3]The respondent believes that the claimant is due to pay damages due to losses sustained as a consequence of the claimant’s actions. The respondent indicated that it would consider its options with regard to litigation for those sums.[4]As agreement was reached in relation to the sums due, a consent judgment is issued.
