JUDGMENT
The claim is struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds that the claim has not been actively pursued in terms of rule 37(1 )(d).REASONS
[1]The Tribunal has received no recent communication from the claimant in this case. A closed preliminary hearing was held on 10th June 2021, the Order of the Tribunal was issued on 23rd June 2021 . The claimant was to comply with the terms of the Order within 14 days from the date on which the Order was sent to the parties. No reply has been received.[2]A reminder letter was sent to the claimant on 21st July 2021 requesting a reply by 28th July 2021. No reply has been received.[3]A further reminder letter was sent to the claimant on 4th August 2021 requesting a reply by 18th August 2021. No reply has been received.[4]On 20 August 2021 the Tribunal gave the claimant an opportunity to give written reasons or to request a hearing in order to consider why the claim should not be struck out.[5]The claimant has failed to respond or give reasons why such a judgment should not be made or to request a hearing. The Tribunal therefore strikes out the claim.
