Miss A MacDonald v North Lanarkshire Council: 4109072/2014

EMPLOYMENT TRIBUNALS (SCOTLAND)
Case No 4109072/2014
Miss A MacDonaldClaimantNorth Lanarkshire CouncilRespondent
Employment Judge Lucy WisemanDate 14 June 2021

JUDGMENT

The claim is struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds that the claim has not been actively pursued in terms of rule 37(1)(d).

REASONS

[1]The correspondence to the claimant at the address provided has been returned marked ‘gone away’. No new address has been provided by the claimant. The claimant’s previous agents have withdrawn from acting for her. They do not hold for her any address other than that in the claim form. In those circumstances it appears that the claim is not being actively pursued. It is therefore struck out.
