JUDGMENT

The response to the claim has been struck out and there is no outstanding application for reconsideration and an Employment Judge has decided to issue the following judgment on the available material under rule 21:[1]The respondent has made an unauthorised deduction from the claimant’s wages and is ordered to pay the claimant the sum of £1,127.52 gross, being payment for 12 shifts, each of 12 hours, at £7.83 per hour.[2]The respondent has failed to pay the claimant’s holiday entitlement and is ordered to pay the claimant the sum of £817.45 being payment in respect of 8.7 days of leave accrued but untaken at date of termination of employment.[3]The respondents breached the Working Time Regulations 1998 by not permitting the claimant a rest break. £208.80 is awarded to the claimant as compensation being wages relative to 20 minutes of rest break in each shift worked.
