JUDGMENT

The claim is struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds that the claim has not been actively pursued in terms of rule 37(1)(d).

REASONS

[1]The Correspondence to the claimant at the address provided has been returned stating “does not live at this address as of 2017”. No new address has been provided by the claimant. The claimant’s previous agent has withdrawn from acting for him. They do not hold for him any address other than that in the claim form. In those circumstances it appears that the claim is not being actively pursued. It is therefore struck out.
