JUDGMENT
[1]It is declared that the Respondent made an unauthorised deduction from the Claimant’s September 2020 wages. The Respondent is ordered to pay compensation to the Claimant in the gross sum of £1,046.40.[2]The Claimant’s holiday pay claim succeeds. The Respondent is ordered to pay compensation to the Claimant in the gross sum of £262.91.[3]The Claimant’s claim of breach of contract in respect of notice pay succeeds. The Respondent is ordered to pay damages to the Claimant assessed in the gross sum of £366.20, representing his entitlement to one week’s notice (40 hours per week multiplied by his hourly rate of pay, £8.72).[4]The Tribunal orders the Respondent to pay an additional award of £732.48 to the Claimant as compensation for not having issued him with a statement of employment particulars, pursuant to s.38 Employment Act 2002.[5]Reasons having been given orally at the hearing, written reasons will not be provided unless they were asked for at the hearing or are requested in writing within 14 days of the date of this judgment being set to the parties.
