JUDGMENT
The claim is struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds of non compliance with an Order of the Tribunal in terms of rule 37 (1)(c) and on the grounds that the claim has not been actively pursued in terms of rule 37(1)(d).REASONS
[1]On 29 February 2024, the respondent made an application for the claim to be struck out on the following grounds: a) the claimant has failed to comply with the Tribunal’s Order of 24 January 2024 (sent to parties on 25 January 2024) to provide a disability impact statement by 21 February 2024. b) the claimant has failed to comply with the Tribunal’s Order of 20 February 2024 to confirm if the claimant wishes to proceed with the claim or to withdraw the claim by 27 February 2024. c) the claimant is failing to actively pursue the claim.[2]On 05 March 2024 the Tribunal gave the claimant an opportunity to give written reasons by 12 March 2024 or to request a hearing in order to consider why the claim should not be struck out. No reply was received from the claimant.[3]The claim is therefore struck out under rules 37(1)(c) and 37(1)(d) of the Employment Tribunals Rules of Procedure 2013. L Wiseman
