JUDGMENT

The claim is struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds that the claim has not been actively pursued in terms of rule 37(1)(d).

REASONS

[1]A letter dated 01/08/2024 was received from the claimant stating he wished to withdraw the claim. We wrote to him on 02/08/2024 asking whether it was simply the UDL head of claim he wished to withdraw or the whole claim. No reply was received from the Claimant to our letter of 02/08/2024, therefore a reminder was issue to the claimant dated 16/08/2024 and no reply was received to this either.[2]A strike out warning letter was sent on 27 August 2024 advising the Claimant that consideration was being given to striking the claim out on grounds that it was not being actively pursued. A response was required by 10 September 2024 to lodge a reply or request a hearing, as the Claimant has failed to respond or give reasons why such a judgment should not be made or to request a hearing. The Tribunal therefore strikes out the claim.
