Mr D Philip v Royal Mail Group Ltd: 4106854/2024

EMPLOYMENT TRIBUNALS (SCOTLAND)
Case No 4106854/2024
Mr D PhilipClaimantRoyal Mail Group LtdRespondent
Employment Judge I McFatridgeDate 26 March 2025

JUDGMENT

The claim is struck out under rule 38 of the Employment Tribunals Procedure Rules 2024 on the grounds that the claim has not been actively pursued in terms of rule 38(1)(d).

REASONS

[1]A Preliminary Hearing Note was issued on 20 January 2025 in which the Claimant was ordered to provide information within certain dates which was not complied with. Further reminders were sent to the Claimant on 17/02/2025 & 26/02/2025 but still no reply was received.[2]A strike out warning letter was sent on 07 March 2025 advising the Claimant that consideration was being given to striking the claim out on grounds that it was not being actively pursued. A response was required by 21 March 2025 to lodge a reply or request a hearing.[3]The Claimant has failed to respond or give reasons why such a judgment should not be made or to request a hearing. The Tribunal therefore strikes out the claim.
