JUDGMENT
The Judgment of the Tribunal is that the first respondent shall pay to the claimant:[1]outstanding holiday pay of £611.14; and[2]outstanding wages of £1,058.29. The second respondent shall be dismissed from the proceedings.REASONS
[1]The claim was presented on 3 November 2023. The claimant seeks to recover outstanding holiday pay and wages. The claim is not defended. It was considered appropriate to list the claim for a final hearing to determine liability and remedy. In advance of the hearing, the claimant provided the Tribunal with documents including payslips and bank statements.[2]At the hearing, the claimant represented herself. There was a Spanish interpreter present. The hearing was held by CVP. There was no appearance by or representation on behalf of either respondent.[3]Having heard evidence from the claimant and having considered the documents before it including the claimant’s final payslip dated 16 August 2023, the Tribunal was satisfied that the claimant is entitled to the sums claimed - holiday pay of £611.14 and wages of £1,058.29.[4]The claimant confirmed in writing to the Tribunal that the first respondent should be found liable for the sums claimed. This was consistent with the claimant’s wage slip which showed her employer as Krystal CSG UK Ltd. The Tribunal informed the claimant that in the above circumstances, the second respondent would be dismissed form the proceedings.
