[1]The Claimants in the attached Schedule to this Judgment were employed by Our Power Energy Supply Ltd (in Administration) 4106840/2019 & Others[2]On 1 February 2019, the Claimants were dismissed by Our Power Energy Supply Ltd (in Administration) by reason of redundancy.[3]Our Power Energy Supply Ltd (in Administration) was obliged to inform and consult with the Claimants in accordance with the provisions of s.188 and S.188A of The Trade Union and Labour Relations (Consolidation) Act 1992 (“the Act”). They failed to do so.[4]On 31 January 2019 Blair Carnegie Nimmo, Saltire Court, 20 Castle Terrace, Edinburgh, EH1 2EG and Alistair McAlinden, 37 Albyn Place, Aberdeen, Grampian, AB10 1JB were appointed Administrators of Our Power Energy Supply Ltd (in Administration).[5]The Claimants have raised a complaint pursuant to section 189 of the Act seeking a protective award in respect of that failure.[6]The Tribunal declares the Claimants* claims are well founded; makes a protective award in favour of the description of employees which includes all employees of Our Power Energy Supply Ltd (in Administration) who were dismissed within 90 days of 1 February 2019; and orders Our Power Energy Supply Ltd (in Administration) to pay remuneration for a protected period of 90 days from 1 February 2019.
