JUDGMENT

The claim is struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds of non-compliance with an Order of the Tribunal in terms of rule 37(1)(c) that the claim has not been actively pursued in terms of rule 37(1)(d)

REASONS

[1]On 24 October and 14 and 15 November 2024, the Tribunal advised the claimant to re-send copies of pay slips and any other additional documents to the Tribunal in order to progress the case, and in its letter of 24 October 2024 set out a warning that in the event that the claimants did not comply with its Orders their claim may be struck out.[2]The claimant has failed to provide these requested documents. The Tribunal therefore strikes out the claim, on the basis that the claimant has failed to comply with its Order, and has failed actively to pursue the claim., having been issued with a strike out warning in the event of non-compliance.
