JUDGMENT
The claim is struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds that the claim has not been actively pursued in terms of rule 37(1)(d).REASONS
[1]On 26 September 2023 the claimant failed to attend a CVP hearing, following which a note was issued on 29 September 2023 and the claimant was given until the 6 October 2023 to provide reasons for their failure to attend the hearing. No further correspondence was received from the claimant.[2]A strike out warning letter was then issued on 10 October 2023 giving the claimant until 17 October to respond.[3]The claimant has failed to respond or give reasons why such a judgment should not be made or to request a hearing. The Tribunal therefore strikes out the claim.
