No response has been presented to this claim an Employment Judge has decided to issue the following judgment on the available material under rule 21:[1]The respondent having unlawfully withheld the claimant’s wages is ordered to pay the claimant the gross sum of One Thousand and Sixty Four Pounds (£1,064.00) (Calculated on the basis of 76hrs x £14.00 p/h)[2]The gross sum of One Thousand One Hundred and Twenty Pounds (£1,120.00) (10 days x 8hrs x £14.00) being accrued holiday pay;[3]The sum of Six Hundred and Thirty Four Pounds and Sixty Two Pence (£634.62) (1 x £33,000 ÷52) as pay in lieu of notice;[4]The respondent shall be at liberty to deduct from the above sums prior to making payment to the claimant such amounts of Income Tax and Employee National Insurance Contributions (if any) as it may be required by law to deduct from a payment of earnings of that amount, and if it does so, duly remits such sums deducted to HM Revenue and Customs, and provides to the claimant written evidence of that fact giving the amount of such deductions and of the sums deducted having been remitted to HMRC.
