The claim is struck out under rule 38 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds that the claim has not been actively pursued in terms of rule 38(1)(d).REASONS
[1]On 22 October 2024 letter were issued to all claimants in the attached scheduled asking them if they wished to withdraw their claims are they were duplicate claims. Further reminders were sent to all claimants on 31 January 2025 and 26 March 2025 but no replies were received from the claimant in the attached schedule.[2]A strike out warning letter was then issued on 07 May 2025 giving the claimants in the attached schedule until 21 May 2025 to respond[3]The claimants in the attached schedule have failed to respond or give reasons why such a judgment should not be made or to request a hearing.
