JUDGMENT
The Judgment of the Tribunal is that the original judgment issued on 11 April 2024 be reconsidered in terms of rule 70 of schedule 1 of the of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013. On reconsideration, the original decision is varied with the effect that the start date of the protected period is amended from 15 June 2023 to 12 June 2023.REASONS
[1]The claimants’ representative presented the claims for a protective award on 22 September 2023. On 21 December 2023, the respondent’s administrator confirmed that they consented to the continuation of the claims and did not intend to defend them.[2]On 10 April 2024, based on the information provided, a judgment was signed in terms of rule 21 of schedule 1 of the of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 (the Tribunals Rules). The judgment was issued to the parties on 11 April 2024 (the original judgment).[3]On 18 July 2024, the claimants’ representative applied for reconsideration of the original judgment in terms of rules 70 and 71 of the Tribunals Rules. The claimants’ representative advised that the start date for the protected period was incorrect. There was an error in the claim form. The application for reconsideration was made outside the 14-day period required by rule 71 because the claimants’ representative was unaware of the error until the Redundancy Payments Service refused to pay the protective award. The claimants’ representative stated that granting the application would be in the interests of justice as it would ensure the claimants received the remuneration to which they are entitled and that the respondent had confirmed the claims were not defended.[4]Employment Judge MacLean has considered the application for reconsideration and decided to grant the application. Following clarification, the claimants’ representative has explained that the error in the claim form was a drafting oversight which had not been checked when the original judgment was issued. While the application is made late, Judge MacLean has decided that it is in the interests of justice to reconsider the original judgment to allow the claimants to receive the sums owed to them. The original judgment is varied to amend the start date of the protected period from 15 June 2023 to 12 June 2023.
