JUDGMENT

The claim is struck out under rule 37(1)(d) of the rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds that it has not been actively pursued.

REASONS

[1]A letter dated 20 October 2023 was sent to the claimant informing him that he needed to obtain the permission of the court to proceed with the case against the second respondent because it was in compulsory liquidation. Further reminders seeking confirmation of the necessary consent or any other relevant information were sent to the claimant on 27 November 2023 and again, nearly a year later, on 11 November 2024. The claimant did not reply to either letter.[2]A strike out warning letter was sent on 27 November 2024 advising the claimant that consideration was being given to striking the claim out on the ground that it was not being actively pursued. A response was required by 11 December 2024. No reply was received. The Tribunal therefore strikes out the claim. M Whitcombe
