Mrs L McNiven v Tesco Store: 4105118/2020

EMPLOYMENT TRIBUNALS (SCOTLAND)
Case No 4105118/2020
Mrs L McNivenClaimantTesco StoreRespondent
Employment Judge David Hoey DateDate 27 May 2021

JUDGMENT

The claim is struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds of non-compliance with an Order of the Tribunal in terms of rule 37(1)(c)

REASONS

[1]Following a case management preliminary hearing heard on 27 November 2020 the claimant was ordered to provide further information as to her claim. The claimant did not comply with the order.[2]On 14 April 2021 the Tribunal gave the claimant an opportunity to give written reasons by 21 April 2021 or to request a hearing in order to consider why the claim should not be struck out.[3]The claimant has failed to give an acceptable reason why such a judgment should not be made. She did not request a hearing. The Tribunal therefore strikes out the claim.[4]The hearing set down for 1 to 3 June 2021 has been cancelled.
