JUDGMENT
The Employment Judge has decided to issue the following judgment on the available material under rule 21.[1]The Tribunal makes a protective award in respect of the employees dismissed as redundant by the first respondent at their site at Unit 7 Logie Way, Logie Business Park, Kirriemuir DD8 5PU and the first respondent is ordered to pay remuneration for the protected period. The protected period begins on 23 February 2024 and is for 90 days.REASONS
[1]This is a claim for a protective award which is not defended, and a Judgment is issued under the provisions of Rule 21. The claimants are entitled to bring this claim because the complaint concerns a failure relating to the election of employee representatives, and the claimants were employees dismissed as redundant. There was no recognised trade union involved. The first respondent dismissed as redundant more than 20 employees at one establishment within a period of 90 days or less from the date of the first dismissal on 23 February 2024. The first respondent failed to ensure that employee representatives were elected in accordance with s.188A, and then to inform and consult with them in accordance with the provisions of section 188.[2]No response from the first respondent was presented to these claims within the applicable time limit. The second respondent neither supports nor resists the protective award claims.[3]The first respondent is in administration. The administrator consented to the continuation of these proceedings by letter dated 14 May 2024.[4]The complaint that the first respondent failed to comply with a requirement of section 188 of the Trade Union and Labour Relations (Consolidation) Act 1992 is well founded.[5]The Judgment has been made as set out above accordingly.
