JUDGMENT

The claim is struck out under rule 37(1)(d) of the Employment Tribunals Rules of Procedure 2013 on the grounds that it has not been actively pursued.

REASONS

[1]On 7 October 2024 the respondent made an application to the Tribunal to strike out the claim on the grounds of the claimant’s non-compliance with the Tribunal’s order dated 12 September 2024 and also on the grounds the claim has not been actively pursued under rules 37(1)(c) and (d) of the Employment Tribunals Rules of Procedure 2013.[2]On 8 October 2024 the Tribunal wrote to the claimant seeking comments on the respondent’s application. No reply was received from the claimant.[3]On 25 October 2024 the Tribunal gave the claimant an opportunity to give written reasons by 1 November 2024 or to request a hearing in order to consider why the claim should not be struck out. No reply was received from the claimant.[4]The claim is therefore struck out under rule 37(1)(d) of the Employment Tribunals Rules of Procedure 2013. M Whitcombe
