JUDGMENT

[1]The complaint of unfair dismissal is not-well founded and is dismissed; 2. the respondent was in breach of contract by failing to give the claimant notice of termination of employment and the respondent is ordered to pay the claimant the sum of £2000.00 [TWO THOUSAND POUNDS] (gross) from which tax and national insurance requires to be deducted, provided that the respondent intimates any such deductions in writing to the claimant and remits the sum deducted to Her Majesty’s Revenue and Customs as damages for the said breach;[3]The claimant’s complaint of unlawful deduction from wages (holiday pay) is not well-founded and is dismissed;[4]The claimant’s claims for arrears of pay and other payments after the termination of the claimant’s employment with the respondent having been withdrawn by the claimant, are dismissed under Rule 52 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013.
