JUDGMENT

The Tribunal lacks jurisdiction to hear the claimant’s complaint of unfair dismissal, the claimant not having the two-year qualifying period of employment required under section 108 of the Employment Rights Act 1996. The complaint of unfair dismissal is, therefore, dismissed. The claimant’s complaint of unauthorised deductions from wages and his claim under Schedule 5 of the Employment Act 2002 in relation to the respondent’s alleged failure to provide a written statement of employment particulars have not been dismissed and shall proceed in accordance with the Case Management Order of even date. ___L Murphy
