JUDGMENT

The claim is struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds that the claim has not been actively pursued in terms of rule 37(1)(d).

REASONS

[1]A strike out warning letter was sent on 30 July 2024 advising the Claimant that consideration was being given to striking the claim out on grounds that it was not being actively pursued. A response was required by 13 August 2023.[2]The claimant responded by e-mail dated 31/07/2024 stating that she could not go further with this case. A letter dated 1st August 2024 was then sent to the Claimant to confirm that she wished to withdraw the claim. No reply was received to this letter. A further reminder was sent on 14 August 2024 giving the claimant until 19/08 2024 to respond to confirm withdrawal of the claim. No reply was received to this letter either, as the Claimant has failed to respond or give reasons why such a judgment should not be made or to request a hearing. The Tribunal therefore strikes out the claim.
