JUDGMENT

The claim is struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds: of non compliance with an Order of the Tribunal dated 02 December 2022 in terms of rule 37(1)(c) * that the claim has not been actively pursued in terms of rule 37(1)(d)

REASONS

[1]On 31 October 2022 the claimant was asked to provide Further and Better Particulars referenced at paragraph 4 of the Note of the Preliminary Hearing held on 20 September 2022 and dated 22 September 2022 and the Scott Schedule referred at paragraph 5 of the Note of the Preliminary Hearing held on 20 September 2022 and dated 22 September 2022. No reply was received.[2]A further reminder was sent by e-mail on 22 November 2022 and again no reply was received.[3]An unless order was issued to the claimant dated 2 December 2022 to provide the information mentioned above and informing them that if a reply was not received by 9 December 2022 the claim would be struck out[4]The claimant has failed to respond. The Tribunal therefore strikes out the claim.
