JUDGMENT
The Judgement of the Employment Tribunal under rule 21 of the Employment Tribunal (Constitution and Rules of Procedure) Regulations 2013 is that;[1]the complaint under section 189 of the Trade Union and Labour Relations (Consolidation) Act 1992 (TULCRA) is well founded;[2]the respondents are ordered to pay a protective award to the claimants in the attached schedule who were dismissed as redundant; the protective period begins on 28 April 2020, and is for a period of 90 days.REASONS
[1]The claimants in the attached schedule presented a claim under section 189 of TULCRA. No response was lodged to that claim, and the tribunal was satisfied that it was appropriate to issue this judgement under Rule 21 of the Employment Tribunal (Constitution and Rules of Procedure) Regulations 2013 (the Rules).[2]The tribunal was satisfied that the complaint under section 189 of TULCRA is well-founded and that a protective award should be made. The protective period begins on 28 April 2020 and is made for a period of 90 days. The award is made to the claimants on the attached schedule, who were dismissed as redundant, and in respect of whose dismissal the respondents failed to comply with the requirements of section 188 of TULCRA.
