JUDGMENT
The Judgment of the Employment Tribunal is as follows: The respondent is ordered to pay to the claimant the following sums –(a) A statutory redundancy payment of TWO THOUSAND TWO HUNDRED AND THIRTY TWO POUNDS (£2232.00);(b) Damages for breach of contract in respect of notice pay of TWO HUNDRED AND THIRTY TWO POUNDS (£232.00); and(c) Holiday pay of FIVE HUNDRED POUNDS AND FIFTY EIGHT PENCE (£500.58).REASONS
[1]I decided that this Judgment could be issued without a hearing in terms of Rule 60 contained in Schedule 1 to the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013.[2]The sums awarded are those claimed by the claimant in terms of her ET1 claim form, which contained sufficient information.[3]No ET3 response form was submitted.[4]The claimant’s notice pay award is calculated under deduction of the sum of £2000 stated in the claimant’s ET1 to have been paid to the claimant by the respondent.[5]The sums due to the claimant in respect of notice pay and holiday pay may be subject to deduction of income tax and employee’s National Insurance contributions and will be satisfied if paid under said deductions.
