No responses have been presented to these claims and Employment Judge Shona MacLean has decided to issue the following judgment on the available material under rule 21:[1]The complaint by the first claimant on behalf of its members for whom it had recognition rights and the 35 other claimants listed in the schedule that the respondent failed to comply with the requirement under Section 188 or Section 188A) of the Trade Union and Labour Relations (Consolidation) Act 1992 was well founded.[2]There should be a protective award made in respect of the first claimant’s members for whom for it had recognition rights and the 35 other claimants listed in the schedule who were dismissed as redundant by the respondent on 8 January 2018.[3]The protected period should be 90 days beginning on 8 January 2018.[4]The respondent is ordered to pay the first claimant’s members for whom for it had recognition rights and the 35 other claimants listed in the schedule the appropriate remuneration under Section 190 of the of the Trade Union and Labour Relations (Consolidation) Act 1992
