JUDGMENT
The claimant having received a payment of his outstanding wages withdraws the claim and the Tribunal accordingly dismisses it.REASONS
[1]This case called for a Hearing on 14 November. I had hoped that matters had been resolved between parties. Mr Orghei confirmed that he had received payment of the sums he had sought but he had also received payment of notice. He was unsure as to whether or not he could accept payment without prejudicing a claim for unfair dismissal which he intended raising. I advised him that accepting the notice pay would not prejudice any E.T. Z4 (WR) claim for unfair dismissal. I reminded him of the time limits that applied in relation to the current proceedings, these having been withdrawn they can be dismissed.
