[1]By consent, the claimant’s claim for a compensation payment in respect of accrued but untaken annual leave (holiday pay) succeeds. Also by consent, the respondent is ordered to pay to the claimant compensation in the sum of Eight Hundred and Twenty-Two Pounds (£822).[2]The respondent is ordered to pay to the claimant the higher amount of Two Thousand, Six Hundred and Thirty-Two Pounds and Forty-Four Pence (£2,632.44) (representing four weeks’ pay at the agreed rate of £658.11) under section 38(2) Employment Act 2002, on account of its failure to provide the claimant with a statement of employment particulars pursuant to section 1 Employment Rights Act 1996. Reasons having been given orally at the hearing, written reasons will not be provided unless they were asked for at the hearing or are requested in writing within 14 days of the date of this judgment being sent to the parties.
