JUDGMENT
The claims are struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds that the claims have not been actively pursued in terms of rule 37(1)(d).REASONS
[1]By email dated 29 November 2022, the claimants’ representative indicated that the matter in dispute had been resolved and that instructions were awaited from the claimants in relation to the claims being withdrawn.[2]The Tribunal gave the claimants until 9 December 2022 to confirm the position. No response was received by this date and the claimants were given an extension to 19 December 2022 to confirm if they were withdrawing their claims or not.[3]The claimant’s agent requested a further extension to 23 December 2022 and this was granted. No response was received and, by letter dated 11 January 2023, the claimants were given a further period to confirm their position.[4]Still no response was received and a strike-out warning was issued on 8 February 2023 requiring a response by 22 February 2023. There was no response.[5]The Tribunal considers that the claimants have not actively pursued their claims and so they are struck-out under Rule 37(1)(d).
