The claim is struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds has no reasonable prospect of success in terms of ruhREASONS
1 . The claimant lodged a claim form on 21 June 2022. On 28 July, the Claimant was asked to provide reasons why the claim was not raised within 3 months of the date of termination of employment, which appeared to have occurred in 2018. The Claimant did not provide any reasons why the claim had not been lodged until June 2022.[2]On 12 August the Tribunal gave the Claimant an opportunity to give written reasons by 1 8 August or to request a hearing in order to consider why the claim should not be struck out.[3]The Claimant has failed to give an acceptable reason why such a judgment should not be made or to request a hearing. The Tribunal therefore strikes out the claim.
