JUDGMENT

The claim is struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds that the claim has not been actively pursued in terms of rule 37(1)(d).

REASONS

[1]On 11 July 2023, the Tribunal sent a letter to the claimant asking him to confirm if he accepted that he does not have the necessary length of service to proceed with a claim for unfair dismissal. The claimant was also asked to confirm the sum claimed in respect of outstanding monies. No reply was received from the claimant.[2]On 2 August and 16 August 2023, the Tribunal issued a reminders to the claimant and asked him to reply to the Tribunal by 9 August and 23 August 2023 respectively. The claimant was informed that a failure to reply may result in a strike out warning. No reply was received.[3]On 12 September 2023 the Tribunal gave the claimant an opportunity to give written reasons by 26 September 2023 or to request a hearing in order to consider why the claim should not be struck out.[4]The claimant has failed to give an acceptable reason why such a judgment should not be made or to request a hearing. The Tribunal therefore strikes out the claim.
