JUDGMENT
The judgment of the Tribunal is as follows.(1) On its own initiative, the Tribunal has amended the name of the respondent to that shown above, following a change of name from “Earnock Builders Hamilton Ltd” on or about 1 June 2023 and recorded at Companies House.(2) The respondent had received proper notice of the hearing and there was no explanation for its failure to attend. In the circumstances, it was fair to proceed with the hearing in the absence of the respondent under rule 47. Case No.: 4103022/2023 Page 2(3) The claimant’s continuous service commenced with “Earnock Limited, trading as Earnock Builders” on 16 October 2019, transferring to the respondent company (then called “Earnock Builders Hamilton Ltd”) under TUPE 2006 on or about 1 March 2021.(4) The claimant was dismissed by the respondent by reason of redundancy with effect from 10 March 2023.(5) The claimant is entitled to a statutory redundancy payment of £2,457, which the respondent is ordered to pay to the claimant.
