JUDGMENT
The claim is struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds: - that the claim has not been actively pursued in terms of rule 37(1)(d)REASONS
[1]On 2 June 2023 the claimant was asked for their comments on the Respondent’s request for postponement, no suitable reply was received to this correspondence.[2]By letter dated 21 June 2023, the respondent’s representative requested a strike out of the claim due to the claimant not actively pursuing their case. A strike out warning letter was then issued on 27 June 2023, giving the claimant until 4 July 2023 to respond.[3]The claimant has failed to respond or give reasons why such a judgment should not be made or to request a hearing. The Tribunal therefore strikes out the claim.
